= &nb= sp; = NOTICE OF EMERGENCY ORDER

Pursuant to Arkansas Code Annotated, Section 8-4-220, The Arkansas Department of Environmental Quality (ADEQ) has issued an emergency order in connection wi= th a gasoline release from a regulated aboveground storage tank in Gravette which began January 11, 2010. The spilled gasoline escaped the tank’s secondary containment system and = some of it entered the City of Gravette’s sewer system, resulting in the temporary evacuation of nearby residences and businesses.

After initial efforts by the tank’s responsible party to respond to the release, the responsible party has informed the ADEQ that there are insufficient financial resources to continue cleanup operations. As a resul= t, the ADEQ has issued the emergency order to authorize spending money from the Arkansas Petroleum Storage Tank Trust fund administered by the ADEQ to prop= erly address the situation.

The order authorizes the emergency response contractor already at the scene of = the release to continue monitoring and stabilization activities for the area affected by the release until emergency conditions are abated and one of the ADEQ’s on-call environmental contractors can begin appropriate site assessment and/or remediation.

Nothing in the order prevents the ADEQ from taking additional enforcement action in connection with this situation, or from seeking to recover any of its costs expended in conjunction with the matter.
