CLASS 1 LANDFILLS

Class 1 landfills are subject to regulation under Subtitle D of the Resource Conservation and Recovery Act (RCRA), Title 40 of the Code of Federal Regulations, Part 258 (40 CFR 258). Subtitle D has been adopted by the State and regulates all municipal solid waste landfill (MSWLF) units that accept household wastes for disposal. Class 1 landfills can accept: Household Wastes, Commercial Wastes, and Approved Industrial Wastes. (Class I Landfill Application Package)

CLASS 3 LANDFILLS

All other solid waste disposal facilities including Class 3 and 4 landfills are subject to the criteria contained in 40 CFR 257 which the state has also adopted and state Regulation 22. There are three categories of Class 3 landfills. (Class 3 Landfill Application Package)

  • Class 3 Tire landfills can accept only tires for disposal.
  • Class 3 Commercial landfills can accept: Commercial Wastes and Approved Industrial Wastes
  • Class 3 Non-commercial can accept: Approved Industrial Wastes

These landfills are for disposal of waste generated solely by the permittee at that industry location. Only Class 3N landfills are exempt from obtaining a Certificate of Need.

CLASS 4 LANDFILLS

Class 4 landfills can accept inert, non-putrescible wastes such as: Construction and Demolition Wastes, Appliances and Furniture, and Other Bulky, Inert Wastes. (Class 4 Landfill Application Package)

COMPOSTING FACILITIES (CLASS CY, CO, CS)

Composting facilities are classified according to the type of waste authorized for composting:

TRANSFER STATIONS (CLASS TS)

Transfer stations are facilities that receive solid waste from collection vehicle and the public for transfer to larger vehicles for long distance transport. Like Type "CY" composting facilities, transfer stations are normally covered under a general permit. (General Permit Transfer Station Application Package)

WASTE RECOVERY FACILITIES (CLASS WR)

Also referred to as material recovery facilities, solid waste is sorted and recyclable materials recovered from the waste stream. Most facilities can be covered under a general permit. (General Permit Waste Recovery Application Package)

WASTE TIRE PROCESSING FACILITIES (CLASS TP)

These facilities process waste tires for recycling uses or for disposal. An individual permit is required, but there is no preliminary application requirement. (Waste Tire Processing Facility Application Packages)

GENERAL PERMITS

Compost facilities (Class CY), Transfer Stations (Class TS), Waste Recovery (Class WR) are facilities that normally are eligible for coverage under a general permit, which is a simplified permit by rule of procedure. General permit coverage can be granted within 30 days of receipt of a complete application. At the Departments discretion, an applicant may be required to obtain a full individual permit.
