Regulation 11
The Arkansas Pollution Control and Ecology Commission
Regulation
11 is currently comprised of:
- Part I. Solid Waste Management Disposal Fees
- Part II. Landfill Post-Closure Trust Fund
- Part III. Recycling Grants Program
This regulation, and the laws that govern this regulation,
encourages the recycling of wastes by applying fees to only
those waste which are received at the landfill.
The purpose of
Regulation
11 is for the Department of Environmental Quality to
develop and implement the following programs:
- A system for the assessment and collection of fees for landfill disposal in the State of Arkansas, and a system for the assessment and collection of fees for waste generated within the State and transported to landfill disposal sites in other states
- The administration of a landfill post-closure trust fund
- The administration of a solid waste management planning and recycling grants program fund. The fund will also be used for administrative costs incurred by Regional Solid Waste Management Districts and for waste management compliance and enforcement activities by the Department of Environmental Quality.
All of these programs are administered by the Solid Waste
Management Division, with the exception of the
Recycling Grants Program
which is administered by the
Solid Waste Management
Division, Recycling Branch.
Regulation 14
The Arkansas Pollution Control and Ecology Commission’s
Regulation
14 is currently comprised of regulations and administrative
procedures for the Arkansas waste tire program. It includes
waste tire storage, collector, transport, processing and
disposal requirements. In addition,
Regulation
14 furnishes administrative guidelines for the distribution
of waste tire grant funds to Regional Solid Waste Management
Districts, which the Districts are required to use to adequately
and properly manage waste tires within their areas.
Regulation 22
The Arkansas Pollution Control and Ecology Commission’s
Regulation
22 regulates all solid waste management facilities like
municipal solid waste landfills, industrial landfills, construction
and demolition debris landfills, transfer stations, composting
facilities, material recovery facilities and waste tire
processing facilities.
Regulation
22 has adopted EPA’s Resource and Recovery Conservation
Act, Subtitle D.
Regulation
22 sets forth minimum criteria for all solid waste management
facilities including location restrictions, facility design
and operating criteria, groundwater monitoring requirements,
corrective action requirements, financial assurance requirements
and closure and post closure requirements.
Regulation 27
The Arkansas Pollution Control and Ecology Commission’s
Regulation
27 is currently comprised of regulations and administrative
procedures for the licensing of operators of solid waste
management facilities. This regulation and the laws that
govern this regulation, encourages sound solid waste management
practices. This regulation is implemented by the ADEQ, with
the advice and assistance of a ten-member
Licensing
Committee.
