Monitoring Well Work Plan

Submit a monitoring well work plan with any new or major modification application packages that include new land application sites. The design and construction of the wells must be completed in accordance with the EPA Handbook of Suggested Practices for the Design and Installation of Ground-Water Monitoring Wells.

Closure Plan

All new and modification application packages are required to have a plan to close the permitted facility and make any site restoration deemed necessary by the department. A detailed cost estimate to close and restore the permitted facility is required, as well as a financial mechanism that demonstrates to the department’s satisfaction the permittee’s financial ability to ensure adequate closure and any necessary restoration of the permitted facility in accordance with the requirements of A.C.A. § 8-4-203. The amount of any financial assurance required under this section shall be equal to or greater than the detailed cost estimate for a third party to close the permitted facility in accordance with closure plans approved by the department.

Waste Management Plan

Waste management plans must be signed and approved by an NRCS area engineer, an Arkansas registered professional engineer, or an Arkansas Soil and Water Conservation District water quality technician.

Land Use Contract/ Deed/ Lease

Proof of ownership or control of land must be submitted to the department for all land to be permitted for waste utilization under the waste management plan. One the following is required:

  • a copy of the deed or other legal documentation of ownership
  • a copy of the lease agreement with the landowner granting control of the land for the purpose proposed in the application
  • a land use contract

Arkansas Department of Health (ADH) Notification Letter

Applicants for new facilities or permit modifications to add land applications sites must notify the Arkansas Department of Health (ADH) Division of Engineering that an application has been sent to ADEQ. This notice must include a complete set of area maps (pop up area maps description) indicating the facility location and all land application sites and description (type, size, etc.) of the operation. The notice should be mailed to:

A copy of the letter transmitting the above documents to ADH must be submitted to ADEQ with application.
