In
light of what has happened on the Bluebird Sand property, why would ADEQ want to
grant these Construction and Discharge Permits? In my view, it is just a
matter of time before an “event” would occur that potentially could damage Piney
Creek and the White River.
I am a
property owner on Mill Creek and have plans to retire to the area. There
is much at stake here and I believe there should be in-depth studies done BEFORE
these permits are approved as to the impact on our streams and drinking water
should such an event take place here with the Evergreen.
I
won’t be able to attend the meeting as I am out of state but please consider my
comments before a decision is made here.

Dear Mr. Wiklund:
This letter constitutes notice of
the Department’s draft permit decision. Enclosed is the public notice, a
copy of the draft State Construction Permit, a copy of the draft NPDES permit
and Statement of Basis which the Arkansas Department of Environmental Quality
(ADEQ) has prepared. In accordance with Arkansas Regulations, the enclosed
public notice will be published by ADEQ in a newspaper of general
circulation of the facility on December 16, 2010.
The ADEQ will hold a public
meeting and hearing at 6 p.m. on Tuesday, January 25, 2011, at Calico Rock City
Hall, 265 Second Street, Calico Rock to accept comments on a draft permit for
construction and operation of the process water retention pond proposed in Izard
County. At said hearing, all interested parties may submit written or
oral statements regarding the draft NPDES permit, and the construction permit,
to the Hearing Officer for consideration. The purpose of said hearing is
to allow public participation in the determination of the terms and conditions
of the issuance of the NPDES permit and the construction permit. ADEQ
technical staff will be available to informally discuss the draft permits. In
addition, a hearing officer will accept public comments during this time. Verbal
comments will be accepted, but written comments are preferred in the interest of
accuracy. The comment period is effective until the close of the public
meeting and hearing. The permit will become effective approximately
two weeks after the close of the comment period unless comments are received
prior to the close of the comment period requiring a delay of the effective
date.
