General No-Discharge Permits

The No-Discharge Section may issue a general permit for similar facilities that require the same type of conditions placed on their operation. Facilities eligible for coverage under a general permit must submit required information to ADEQ and obtain notification of their coverage in order to operate. ADEQ may deny coverage under a general permit and require the submission of a permit application for an individual permit.

ADEQ will consider issuing a permit to facilities seeking coverage when payment has been received. Follow the permitting procedures under each general no-discharge permit type.

Most General No-Discharge Permits may be completed and submitted online through the ADEQ ePortal site.

  • Select Organization. A drop-down menu will appear.
  • Scroll to Water Division and select No-Discharge Permits to find form selections.
  • Before using ePortal, register online then download and complete the ADEQ Electronic Signature Agreement form and mail it to the Electronic Signature Agreement Committee, Arkansas Department of Environmental Quality, 5301 Northshore Drive, North Little Rock, AR 72118.

The Waste Management Plan provides ADEQ with the operational plans and specifications of the subsurface system. To ensure proper installation and operation of these systems, ADEQ requires that the Waste Management Plan be signed and approved by either an Arkansas registered professional engineer or an Arkansas Department of Health designated representative. The monitoring requirements were added to this permit to ensure the permittee is properly operating and maintaining the subsurface distribution system.

Proof of ownership or control of land must be submitted to the department for all land to be permitted for waste utilization under the waste management plan. One the following is required:

  • a copy of the deed or other legal documentation of ownership
  • a copy of the lease agreement with the landowner granting control of the land for the purpose proposed in the application
  • a land use contract

Applicants for new facilities or permit modifications to add land applications sites must notify the Arkansas Department of Health (ADH) Division of Engineering that an application has been sent to ADEQ. This notice must include a complete set of area maps (pop up area maps description) indicating the facility location and all land application sites and description (type, size, etc.) of the operation. The notice should be mailed to:

Design and implementation of waste management plans shall be in accordance with all applicable state and federal regulations and department guidelines and policies. ADEQ requires that a Waste Management Plan be signed and approved by either an Arkansas registered professional engineer or an Arkansas Department of Health designated representative. All construction plans, specifications and design calculations must be signed and stamped by an Arkansas registered professional engineer.

  • An AOGC “Authority to Dispose” letter
  • An approved AOGC Form 23 (for a change of operator only)
  • Any other AOGC approved form to to construct and/or operate a Class II Salt Water Disposal well
  • Find the Arkansas Oil and Gas Commission forms, contacts and detailed information on their website under AOGC General Operator Requirements
A copy (8 ½" X 11") of both the USGS topographic quad sheet map and county map showing the location of the facility, and the nearest waterbody, water supplies, dwellings, and property lines, and including transmission lines (above and below ground surface); including the name and distance to the nearest waterbody.

Site plan/schematic diagram of the disposal system showing:

  • connected wells
  • tanks (type and sizes and capacity in barrels)
  • treaters, gunbarrels, separators
  • pumps
  • cut-off switches
  • emergency storage (firewalls) dimensions
  • piping (sizes and materials)
  • composition of secondary containment
Calculations of containment volumes to demonstrate adequate secondary containment capacity of at least 1.5 times the size of the largest tank within the secondary containment area.
List of production wells connected to the system or list of production wells from which the well receives salt water INCLUDING the volumes of salt water received from each production well.
