Permit Change of Name and/or Ownership

All applications for name or ownership change must be submitted thirty (30) days before the effective change.

Name Change

This is for facilities that wish to change their company name, but are not having a change in ownership.

  1. A cover letter stating you need the name changed. The old name, the new name, the AFIN (or CSN) and permit numbers should be included.
  2. Section I, Section II (Item 18 Only), and Section XII of the Air Permit Application Forms. Be sure you put the NEW information and enter the facility name exactly as you want it listed on the permit.

Ownership / Transfer Change

  2. A notarized statement of liability. See the: Since this form cannot be completed until the transfer of ownership takes place, submit all other information thirty (30) days prior to the anticipated change and submit this form as soon as possible after the change has taken place.
  3. A Disclosure Statement. If a Disclosure Statement is submitted, all of the areas must be completed even though the section may not be applicable. A responsible person of the company that has acquired a facility must execute the application form and Disclosure Statement. (The Disclosure Statement must be an original and there must be a separate, completed air permit application for each affected facility.)

    A parent company's current annual report and the periodic report filed with the Securities and Exchange Commission can be substituted for the Disclosure Statement.

Air permits are currently transferable despite the language written within the content of older permits. The permit transfer is governed by Arkansas Code Ann. §8-1-106. Additionally, there is no fee associated with a change in ownership and there is no requirement for a public notice.

Subsequent to the receipt of the Air Permit Application, the Statement of Liability and the Disclosure Statement or the Annual/SEC report and in accordance with Department procedures, if no concerns are noted, the change will automatically take place within 30 days from date of receipt of all completed documents. Upon approval of the change, if applicable, we will modify the existing permit to denote the date of the ownership change and new permittee's name. We ask that you be sure to clearly identify, in the "Applicant Information" section and in the cover letter, the permittee's name to be recorded on the revised permit, i.e., AX Corporation d.b.a. XYZ Facility.

The criteria for change of ownership are addressed in the Department's Regulations: Regulation 18 (§18.307(B)), Regulation 19 (§19.407(B)) and Regulation 26 (§26.901(D)). Please note the 30-day provision. This is the time frame we use to review your submittals.
